Acceptable Use Policy (”AUP”)

  As a provider of website hosting and other Internet-related services, OULU CLOUD provides its clients (also known as ”subscribers”) and its clients and users with access to and dissemination of a large number of public, private, commercial and non- Business Instrument Information. OULU CLOUD respects that the Internet provides a forum for free, open discussion and dissemination of information. However, OULU CLOUD reserves the right to take certain preventive or corrective actions when there are competing interests. To protect these competing interests, OULU CLOUD has established an ”Acceptable Use Policy” (”AUP”) which supplements and explains certain aspects of each customer's respective service agreement Terms, designed to guide customers' rights and obligations when using OULU CLOUD services. This AUP will be revised from time to time. An important aspect of the internet is that no one party owns or controls it. This fact says a lot about the openness and value of the Internet, but it also speaks highly of the judgment and responsibility of those who use the Internet, both in the information they obtain and in the information they transmit to others . When subscribers obtain information via the Internet, they must remember that OULU CLOUD cannot monitor, verify, warrant or guarantee the accuracy and quality of the information they obtain. Accordingly, subscribers must use their best judgment and rely on information obtained from the Internet and should be aware that some material posted to the Internet may be pornographic or otherwise offensive. Because OULU CLOUD cannot monitor or censor the Internet and will not attempt to do so, OULU CLOUD cannot accept any responsibility for harm to its users due to inaccurate, inappropriate, offensive or illegal Internet communications. When subscribers disseminate information from the Internet, they must remember that OULU CLOUD does not review, edit, review or be responsible for any information that its subscribers may create. When users place information on the Internet, they are equally liable for copyright infringement, defamation and other harmful speech as other authors. In addition, since the information created is carried out through the OULU CLOUD network and may reach a large number of users, including rainbow network subscribers and non-subscribers, users' postings on the Internet may affect other subscribers and may affect OULU CLOUD goodwill, business, reputation or operations. For these reasons, the Subscriber is in violation of the OULU CLOUD Policy and Service Agreement when it, its customers, affiliates or subsidiaries engage in the following prohibited activities:

Spam:

Send unsolicited bulk and/or commercial information over the Internet. Not only does it negatively affect consumer attitudes towards OULU CLOUD, but it is not only harmful because it overloads the OULU CLOUD network and disrupts the services of OULU CLOUD users. Also, maintenance of an open SMTP relay is prohibited. Upon receipt of a complaint, OULU CLOUD will investigate and close the spam-sending account. Violations of this policy will be charged $250 to be paid by the individual originating the spam. Furthermore, OULU CLOUD reserves the right to prosecute for such violations. If OULU CLOUD elects to sue, a fee of $1.00 per email sent will be assessed.

IRC is allowed on our servers. Note that your server may hang if you abuse it and cause disruption to other clients.

Adult-oriented content:

OULU CLOUD does not allow adult content and will suspend/terminate any offending accounts.

Obscene speech or material:

The use of the OULU CLOUD network to advertise, transmit, store, post, display or otherwise make available child pornographic or obscene speech or material is prohibited. OULU CLOUD is required by law to notify law enforcement agencies when they become aware of child pornography being present or transmitted through its network.

Seeds

All torrents, including legal torrents, are banned on our servers. This includes torrent trackers. Any website hosting torrents, or torrent trackers will be suspended. URL downloaders, website/file copying utilities are also prohibited. OULU CLOUD will issue a $100 research/cleanup fee for any client found hosting torrents.

Title Forge:

Forgery or misrepresentation of message headers, either in whole or in part, to obscure the originator of a message.

Illegal or unauthorized access to other computers or networks:

Illegal or unauthorized access to a computer, account, or network belonging to another party, or security measures that attempt to penetrate another person's system (often referred to as ”hacking”). Additionally, any activity that could be used as a precursor to a system penetration attempt (ie, port scanning, stealth scanning, or other information gathering activities).

Spread Internet viruses, worms, Trojan horses or other destructive activities:

Distribute information about the creation and delivery of Internet viruses, worms, Trojan horses, pings, floods, mail bombings or denial of service attacks. In addition, activities that disrupt another's ability to use or interfere with another's ability to effectively use the network or any internetwork, system, service, or device.

Promoting violations of this AUP:

Advertise, transmit or otherwise make available any software, programs, products or services designed to violate this AUP, including tooling for spamming, pinging, flooding, mail bombing, denial of service attacks and software piracy.

Export control violations:

Remit encryption software to a point outside the United States via the Internet or other means.

Use netgroup:

OULU CLOUD reserves the right not to accept posts from newsgroups because we actually know the content of newsgroups violates the AUP.

Other illegal activities:

Engage in activities determined to be illegal, including but not limited to advertising, spreading or otherwise offering Ponzi schemes, pyramid schemes, fraudulent credit cards and pirated software.

Other activities:

Engage in activities, whether legal or illegal, that OULU CLOUD determines are harmful to its subscribers, operations, reputation, goodwill or customer relationships. As we have already pointed out, the responsibility for avoiding the harmful activities described above lies primarily with the subscriber. OULU CLOUD does not, as a matter of practice, monitor the communications of its users to ensure compliance with OULU CLOUD's policies or applicable law. However, when OULU CLOUD becomes aware of harmful activity, it may take any action to prevent the harmful activity, including but not limited to deleting information, closing websites, implementing filtering software designed to prevent crime, denying access to the Internet, or otherwise in the opinion of OULU CLOUD any other action as appropriate. OULU CLOUD is also aware that many of its users are providers of Internet services themselves, and from these subscribers information reaching the OULU CLOUD facility may come from the subscriber's customers or from another third of the users. party. OULU CLOUD does not require users of Internet services to monitor or review transmissions or websites created by its users' customers. OULU CLOUD reserves the right to act directly on its user clients. However, OULU CLOUD may monitor its services electronically to determine that its facilities are operating satisfactorily. In addition, OULU CLOUD may disclose information about users, transmissions using our network or website, including but not limited to such information, in order to comply with court orders, subpoenas, subpoenas, requests for discovery, power of attorney, statutes, regulations or government requests .
